Presale Terms & Conditions
These Presale Terms and Conditions govern your participation in The Ashana Founding Member initiative, operated by Atlantisavana Lda., a company registered in Portugal. By participating, you agree to the following terms in full.

1. Purpose of the Presale
The presale offers early supporters the opportunity to secure Founding Member status and associated privileges. Participation does not constitute a confirmed booking, nor is it a guarantee of a future stay on specific dates.

2. Founding Member Benefits
Founding Members receive:

• Up to 50% discount on future stays

• A hand-curated gift package

• Exclusive pre-release booking link before public reservations

• Name engraved on the Founding Members Wall at The Ashana

• Priority access to future offers and limited-edition experiences

These benefits are subject to availability, and may evolve as needed without materially diminishing the value of the offer.

3. Nature of Presale Participation
No specific dates or room categories are being reserved at this stage.

The presale is not a vacation ownership agreement, timeshare, or real estate investment.

The presale is non-refundable, but transferable once the hotel is operational.

4. Payment and Redemption
Presale participants may be asked to submit a deposit or full payment for future room nights when presale opens (estimated Summer 2025).

All payments will be applied as credit toward your future stay at The Ashana when bookings open (expected late 2026).

This credit may be redeemed only for accommodations and services at The Ashana once operational.

5. Construction Disclaimer and Force Majeure
The Ashana is currently under development, with a projected opening in late 2026. While every effort is made to meet this target, Atlantisavana Lda. makes no absolute guarantee regarding the opening date.

You expressly agree that:

Construction timelines are subject to permitting, supply chain logistics, force majeure, and other unforeseeable delays.

In the event of delays, all presale commitments will be postponed accordingly, and no refunds shall be issued due to changes in delivery schedule.

If the project is unable to be completed, Atlantisavana Lda. may offer a refund at its sole discretion.

Atlantisavana Lda. shall not be held liable for losses, damages, or perceived value diminution resulting from any delays, changes, or failure to complete the project.

6. Limitations of Liability
Atlantisavana Lda. shall not be responsible for:

Costs associated with alternative travel or accommodations

Emotional distress or inconvenience caused by project delays

Business or financial losses tied to speculative booking intentions

Under no circumstances shall Atlantisavana Lda. be liable for damages exceeding the total amount paid by the participant toward the presale.

7. Governing Law and Dispute Resolution
These terms are governed by the laws of Portugal. Any disputes shall be resolved exclusively in the courts of Faro, Portugal. By enrolling in the presale, you waive any right to pursue collective or class-action claims.

8. Modification of Terms
Atlantisavana Lda. reserves the right to modify or update these terms at any time without notice, provided such changes do not retroactively reduce any paid entitlements.
